Breaking: Florida Judge Makes Major Ruling On Case Pertaining To DeSantis’ Migrant Flights To Democrat Cities

The legal conflict concerning GOP Governor from Florida, Ron Desantis’ initiative to fly out illegal aliens to other states of the U.S. will be facing a legal trial.

The officials from the DeSantis administration are challenging the lawsuit and demanding that the case should be dismissed. However, according to a report by the Epoch Times, on January 13th, Leon County Circuit Judge John Cooper gave a ruling to take the case to trial. The lawsuit is backed by Democrat state Sen. Jason Pizzo.

“I think we need to just hear out these issues,” the judge said.

The communications director for the governor, Taryn Fenske, stated that “states like Massachusetts, New York, and California will better facilitate the care of these individuals who they have invited into our country by incentivizing illegal immigration through their designation as ‘sanctuary states’ and support for the Biden administration’s open border policies.”

Back in September last year, Pizzo brought forward an emergency complaint for the Injunction and declarative maintenance in Florida’s 2nd Judicial Circuit in Leon County. The lawsuit, in which Pizzo claims his stance as a “citizen and taxpayer of the State of Florida”, has named DeSantis, FDOT Secretary Jared Perdue, and FDOT Chief Financial Officer Jimmy Patronis as defendants.

Pizzo claimed that DeSantis was involved in several legal violations which includes the implementation of the airlift program using the annual state budget bill which the Florida Constitution prohibits, rather than using the substantive law. The complaint also proclaims that the Florida Constitution grants that “[n]o money shall be drawn from the treasury except in pursuance of appropriation made by law.” Pizzo contends that using state funds to transport illegal aliens into and out of Florida violates state law.

Recently on last Friday, DeSantis instructed the state National Guard troops to perform active duty following the continuous wave of illegal immigrants in the Florida Keys. The Republican Governor grilled President Joe Biden over his failures to fix the border crisis and blasted Biden’s response towards the issue. He added that the Biden administration has “failed to provide the resources necessary to respond to the current mass migration event.”

DeSantis’ instructions also direct the law enforcement authorities of Florida and several other state agencies to assist the local government as they face the growing number of illegal immigrants coming towards South Florida.

“As the negative impacts of Biden’s lawless immigration policies continue unabated, the burden of the Biden administration’s failure falls on local law enforcement, who lack the resources to deal with the crisis,” said DeSantis. He added, “That is why I am activating the National Guard and directing state resources to help alleviate the strain on local resources. When Biden continues to ignore his legal responsibilities, we will step in to support our communities.”

The order further added:

It is specifically troublesome for the Monroe County Sheriff’s Office, which includes nearly 194 deputies, to arrange the required resources to control the huge wave of illegal immigrants and uphold public safety. The Response of the Biden administration to this chaotic movement has been very careless, as they have failed to lay out the resources needed to manage the current influx of immigrants. Instead, the burden is falling on the local law enforcement authorities, which also puts the Florida public at risk.

Florida is looking forward to utilizing air assets, such as aircraft and helicopters that are under the Florida National Guard. This measure will also support the Florida Fish and Wildlife Conservation Commission marine patrol to back the water interdictions while also ensuring the safety of illegal immigrants trying to approach Florida via the Florida Straits.

Florida has always prioritized the aid of illegal refugees, like the Cubans and several others fleeing communist governments, seeking help as soon as they enter the United States of America. 

“Since August 2022, federal, state, and local law enforcement have encountered more than 8,000 migrants in waters off the coast of Florida,” the order noted further.

Recent reports have indicated that earlier this week, Border Patrol officials came across nearly 90 immigrants belonging to Cuba off the Florida Keys’ coast. On Sunday, approximately 300 illegal immigrants arrived at the Dry Tortugas National Park. Moreover, 45 additional illegal immigrants arrived at Key West.
