‘Your Home is Your Castle’: 4 Sheriff’s in New York Promised to Ignore Governor Cuomo’s Thanksgiving Restrictions
Erie County Sheriff Tim Howard, Fulton County Sheriff Richard Giardino, Washington County Sheriff Jeff Murphy, and Saratoga County Michael Zurlo all said that they are refusing to enforce the restrictions put in place by Democratic Governor Andrew Cuomo, especially on Thanksgiving. Sheriff Howard was the first when he said that his office will be ignoring the new requirements of 10 people or less gathering inside private homes.
Sheriff’s Giardino, Murphey, and Zurlo all followed suit promising to ignore the order as well. Sheriff Giardino questioned the Constitutional basis of the rules in a Facebook post. He posted, “Frankly, I am not sure it could sustain a Constitutional challenge in Court for several reasons including your house is your castle.” He said that his office has limited resources and legal options when it comes to entering private homes and that they won’t even try to obtain search warrants to see how many people are inside. “We have limited resources and we have to set priorities, so obtaining a Search Warrant to enter your home to see how many Turkey or Tofu eaters are present is not a priority.”

Sheriff Murphey said that his office will not be enforcing this order and Sheriff Zurlo explained how he doesn’t see the point in using crucial resources to be number counters. He said, “I can’t see how devoting our resources to counting cars in citizens’ driveways or investigating how much turkey and dressing they’ve purchased is for the public good.”
But after these announcements came from the Sheriffs the senior advisor for Cuomo, Richard Azzopardi, said, “Politicians acting like politicians and ignoring what the actual experts say has been fueling the spread of this virus is what plunged this country in this continued public health crisis in the first place. We urge everyone to continue to be smart and act responsibly. We know this makes people unhappy, but better unhappy then sick or worse.”
