Michigan Restaurant Association Sues the State Over the Recent Lockdowns Banning Indoor Dining from Governor Whitmer
On Sunday, Democratic Governor Gretchen Whitmer announced that the state of Michigan is heading into lockdown that bans indoor dining, forces some schools to close, people to work from home (if they can), barbershops and salons can stay open and students in 8th grade or younger can attend school in person. This new lockdown order is expected to last about three weeks from November 18 – December 8.
Now, the Michigan Restaurant Association is suing the Michigan Department of Health and Human Services (MDHHS). The association noted that they tried very hard to make some sort of agreement before the announcement was made with the department so that restaurants wouldn’t have to eliminate dine-in eating.

President of the association, Justin Winslow said, “We have taken this action only after careful deliberation and as the last available option to prevent the outright devastation of restaurant operators and their hundreds of thousands of employees across the state.”
He continued, “We want to be clear that we made several good faith efforts in advance of the public release of the Order issued November 15 to reach a compromise with the MDHHS that would have supported the goal of minimizing the risk while still allowing for the continued operation of dining rooms.”
The lawsuit is requesting a federal judge to rule the health department’s order unconstitutional and grant an injunction that would allow restaurants to serve seated customers. The suit states that the commerce clause of the Constitution has been violated by the order.
Speaking about the lawsuit he said, “We are hopeful for a swift and decisive victory in court so restaurant operators may return to what we know they do best – adding value to our lives and our economy by providing a great meal and exceptional hospitality in a safe, socially distanced, sanitized and regulated environment.”
