Huge Win! Federal Judge Rules To Overturn Biden Policy

Texas and Missouri Attorney Generals Ken Paxton and Eric Schmitt had filed a lawsuit against the Biden administration to overturn the executive order that lead to the border disaster.

Federal Judge Matthew Kacsmaryk on Friday issued a nationwide injunction, ordering the Biden administration to reinstate President Trump’s “remain in Mexico” policy.

Judge Kacsmaryk ruled that the Biden administration must “enforce and implement MPP in good faith until such a time as it has been lawfully rescinded in compliance with the [Administrative Procedure Act] APA and until such a time because the federal has sufficient detention capacity to detain all aliens subject to mandatory detention under Section 1255 without releasing any aliens due to a scarcity of detention resources.”

Judge Kacsmaryk concluded that the federal “failed to think about several critical factors, including the advantages of the remain in Mexico policy,” and failed “to show a reasoned decision” for canceling MPP.

Attorney General Schmitt responded to this ruling, “My office has been leading the way nationally in fighting human trafficking, and therefore the Biden Administration’s lax border policies increase the danger for human trafficking at the border and, in turn, in Missouri,” AG Schmitt said. “Today’s massive win was crucial – re-implementing the Migrant Protection Protocols will help secure the border and fight the scourge of human trafficking.”

Texas Attorney General Paxton also responded positively to this ruling, in a tweet, he mentioned “HUGE WIN! We just had our 2nd win on our border lawsuits. My goal is to win them all. This nation deserves a secure and secure border.”

President Trump had implemented this “remain in Mexico” policy which successfully ended “catch and release” This policy was terminated by Joe Biden when he took office in January claiming that this policy does not “adequately or sustainably enhance border management.”

This lead to a massive increase of illegal immigrants coming to the southern border and was one of the key reasons that lead to the southern border disaster this year.
