BOOM: Legal Documents For America First The Supreme Court Has Issued A Brief In Support Of Trump’s Fight Against The January 6th Committee

On Tuesday, the conservative group America First Legal (AFL) issued a formal brief with the United States Supreme Court in favor of former President Donald Trump’s appeal against the January 6 select committee.

According to a news release from AFL, which was headed by former Trump senior advisor Stephen Miller, the organization is asking the Supreme Court to “rein in” the committee and “defend the system of checks and balances and the rule of law.”

After a federal appeals court decided in favor of the January 6 committee, which had requested hundreds of pages of Trump’s emails and other records the committee believed were pertinent to last year’s disturbance at the U.S. Capitol, Trump filed a petition with the Supreme Court at the end of December.

The former president is attempting to halt the January 6 committee’s broad demand, while simultaneously requesting that the Supreme Court weigh claims that his conversations are secured by executive authority and that the committee’s demand serves no “valid legislative purpose.”

As to the federal court judgment, President Joe Biden twice refused to recognize Trump’s declaration of executive authority in October.

In a comment on his organization’s amicus brief, Gene Hamilton, the AFL’s vice president and general counsel, warned that the Biden administration and congressional Democrats are charting a course that will result in the loss of executive privilege.

The Biden Administration and its friends in Congress, who appear to have no respect for the past and no expectation of the future, are forging a road that will result in the loss of executive privilege, said Hamilton.

Their hurry will undoubtedly diminish the effectiveness of such checks and balances, to the disadvantage of all Americans. AFL said in the brief, among other things, that Biden and his allies in Congress pounced on ‘interbranch accommodation’ to avoid constitutional constraints, and to reveal former President Trump’s documents.

It further claimed that the committee lacks the jurisdiction to request presidential documents and that it was not created nor operates in accordance with House rules.

The committee, chaired by House Speaker Nancy Pelosi (D-CA) and comprised of nine of her selected colleagues, has issued subpoenas and other requests for data to scores of Trump’s friends as it examines the “facts, circumstances, and causes” of the January 6 breach.
