Breaking: LA Judge Delivers A Major Blow To Hollywood Star Alec Baldwin, Allows New Lawsuit Accusing The Actor of ‘Despicable Conduct’

Actor Alec Baldwin is not getting the typical Hollywood treatment. 

While he may still face criminal charges for the deadly shooting of cinematographer Halyna Hutchins on the set of the movie, “Rust,” the actor will face the lawsuit brought by the script supervisor on the film. 

Mamie Mitchell accused Baldwin of “recklessly” firing the gun that killed Hutchins in October 2021. Mitchell was standing in close proximity to Hutchins, 42 when the shooting occurred. 

In a Los Angeles County Superior Court, Judge Michael Whitaker refused to toss Mitchell’s lawsuit against Baldwin. 

The judge ruled that Mitchell’s claims of assault, intentional infliction of emotional distress, and negligence can proceed. 

“For pleading purposes, the Court finds the second amended complaint alleges facts sufficient to establish despicable conduct carried out by [the defendants] with a willful and conscious disregard of the rights or safety of others.

“Accordingly, the court denies the motion to strike.”

Mitchell’s lawyer, Gloria Allred, said, “We are very happy that we won, and that the court today permitted us, over the objection of Alec Baldwin, to proceed in our lawsuit against him on our theories of assault, intentional infliction of emotional distress and negligence.”

Baldwin was not the only one named in the suit. The assistant director who handed the gun to the actor, David Halls, and the armorer in charge of weapons on the movie set in Santa Fe, New Mexico, Hannah Gutierrez Reed were also named.

In her statement regarding the ruling, Allred added, “Ms. Mitchell looks forward to her trial and obtaining justice.”

Mitchell is also in a position to pursue punitive damages against Baldwin and his finance company, El Dorado Pictures.

Baldwin maintains that the gun went off accidentally and he did not pull the trigger though an FBI forensic report says the weapon could not have fired otherwise. 

While the actor settled one civil suit over the death with the cinematographer’s family, there are at least four other lawsuits he’ll face brought by other crew members. 

Baldwin’s attorney, Luke Nikas, responded to the ruling by saying, “The Court was required to assume at this stage that Mitchell’s allegations against Alec Baldwin were true — even though they are demonstrably false, made in bad faith, and contradict her own prior statements about what happened.”

On the positive side, his attorney continued, “We are pleased the Court dismissed some of her claims and look forward to disproving the rest of her case, now that she can no longer shield her misrepresentations from the evidence.”

The filming of “Rust” will resume in January 2023 with Hutchins’ widower, Matthew acting as the executive producer. He announced that all “original principal players” will be on board. 

This announcement came once the civil case brought by her family against the actor and Rust Movie Productions LLC was settled.
