Earlier this week on Thursday, a federal judge selected by former President Bill Clinton has recently dismissed former President Donald Trump’s request to disqualify himself from his case against Hillary Clinton, his 2016 presidential adversary.

According to the Daily Mail, U.S. District Judge Donald Middlebrooks claims he has never met the Clintons in his five-page order and that Trump is judge-shopping. Middlebrooks noted, “Every federal judge is nominated by a president who is linked with a major political party, and hence every federal judge may conceivably be considered as indebted, to some extent or another.”

“As judges, we must all be able to rise beyond politics.” His sole relationship to Bill Clinton, he remarked, is when he appointed him to the Supreme Court. During the month of March, Trump sued Clinton and numerous other Democrats, claiming that they framed him and accused him and his 2016 campaign of cooperating with the Russian Federation.

The case was assigned to Middlebrooks, who was appointed to the Southern District of Florida federal court by President Clinton in 1997.

Middlebrooks made clear in his decision that almost all judges may be assumed to have political histories just by virtue of their appointments, but that he should be considered unbiased in the absence of any evidence to the contrary.

He went on to say that judges have a responsibility to withdraw themselves if a charge of prejudice is made, but they also have a responsibility not to recuse themselves if the accusations are made as part of “litigation tactics” which is sometimes known as judge shopping.

The judge’s decision came in response to a request submitted by Trump’s lawyers Alina Habba and Peter Ticktin on Monday.

“There is no question that Judge Middlebrooks’ impartiality would be questioned by a disinterested observer, fully informed of the facts, due to Judge’s relationship with the Defendant, either, individually, or by the very nature of his appointment to the Federal Bench, by the Defendant’s husband. The most important issue is not simply that justice must be done, but also that justice must appear to be done. This could not be more important in a case like the above styled cause, where wrongs in regard to a presidential election are to be redressed,” the motion clearly highlighted.
