With the recent extension of the eviction moratorium put in place by the CDC, along with associated penalties and fines, have come the questions of legal authority.
The Supreme Court recently ruled on the matter, saying that by enacting the original moratorium, the CDC had overstepped its legal authority. Any extension after the July 31st expiration would require Congressional action.
The Biden administration even pointed to this decision by the Court, saying that an extension of the ban would be unconstitutional.
True to form, California Congresswoman Maxine Waters swooped in to undermine both the Constitution and the Supreme Court.
Her statement to the CDC?
“Just do it!”
“I don’t buy that the CDC can’t extend the eviction moratorium – something it has already done in the past! Who is going to stop them? Who is going to penalize them? There is no official ruling saying that they cannot extend this moratorium. C’mon CDC – have a heart! Just do it!” the 31-year Congressional veteran tweeted.
Of course, she doubled down.
“The Supreme Court DID NOT rule on or even take up the case on the legality of the CDC eviction moratorium. Every minute wasted means another family could be forced onto the streets. Biden, #ExtendTheMoratorium now!”
Actually Maxine, the DID.
What they decided on June 29th was not to stop the existing ban, rather choosing to let it expire on July 31st.
Justice Kavanaugh wrote, “In my view, clear and specific congressional authorization would be necessary for the CDC to extend the moratorium past July 31.” He also noted that he agreed with the lower court that the CDC had “exceeded its existing statutory authority” by issuing the original eviction ban.
Regarding the Constitutionality of the first ban, according to CNN, the Supreme Court “denied the landlord’s request for emergency relief. But Biden was reading the writing on the wall. Kavanaugh suggested that after the expiration, he thought Congress would have to act anew. Because four other conservatives, Clarence Thomas, Samuel Alito, Neil Gorsuch and Amy Coney Barrett noted that they would have sided with the landlords, and Kavanaugh said he was willing to do so after expiration, it seems clear extending the mandate could be in similar trouble.”
White House Press Secretary Jen Psaki chimed in with a lie, saying “that Biden’s comments about legal obstacles should not be understood to mean the ban was vulnerable to court challenges.
‘This is a narrow, targeted moratorium that is different from the national moratorium,’ Psaki said. ‘This is not an extension of that.'”
But, it is a complete extension of the “national moratorium.” But in this round, the CDC has added some new penalties.
Now, it is a federal “law” that you cannot charge the people living on your property rent. And you cannot evict them. If you do, you can be fined $100,000 if no death results from the eviction. You will be fined $250,000 if you evict someone and they die as a result. Both scenarios also land you in jail for a year.
According to a letter written by Maxine Waters to Speaker of the House Nancy Pelosi, she further extends the lie about the Supreme Court decision and then offers research (with no mention of who did the research) that more than 433,000 cases of COVID were a direct result of being evicted, and those same evictions led to more than 10,000 COVID deaths.
She also stated in the letter that “those most likely to be evicted in the coming days and weeks are also the same people least likely to be vaccinated.”
The argument Waters is making is this: people who don’t have to pay rent anymore cannot afford to go and get a shot that cost them $0, thus, evicting them makes them more susceptible to dying of the pandemic.
Fox News’ Tucker Carlson summed it up succinctly:
The CDC “announced today that she has decided to nationalize America’s rental properties, millions and millions of them from Maine to California. Tenants are no longer required to pay their rent.
Property owners cannot evict them under any circumstances. Making someone pay to live on your property is now a federal crime. Try it, and you can wind up in prison, with hundreds of thousands of dollars in fines. At the same time, you should know, property owners will still be required to pay the banks that hold their mortgages. There’s no moratorium on mortgages. Why? The banks are huge Democratic donors, and they’re getting the treatment they paid for. Sandy Cortez and The Squad aren’t calling for the banks to do their part. It’s property owners who will suffer, many of them members of the rapidly disappearing American middle class.
It’s hard to overstate what a momentous change this is. It means among other things that private property no longer exists in the United States. You thought you owned your home. Not anymore. Rochelle Walensky (CDC Director) does. She’ll decide who can live there, under what circumstance and for how long.”
Waters statements are contradictory at best, yet she just keeps making them.
